Truck Flow provides fleet management tools, electronic logging device (ELD) hardware and software, dispatch and analytics platforms, and related trucking industry services. Features may change from time to time at our discretion.

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Use the Services in violation of any applicable law or regulation
Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems
Reverse engineer, decompile, or attempt to extract the source code of any Truck Flow software or hardware
Use the Services to transmit malicious code, spam, or infringing content

6. Intellectual Property

All content, trademarks, logos, software, and materials provided through the Services are the property of Truck Flow, LLC or its licensors and are protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services solely as intended.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Truck Flow, LLC and its officers, directors, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, business, or goodwill, arising out of or related to your use of or inability to use the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage. To the extent liability cannot be excluded by law, our aggregate liability for any claim arising out of or related to these Terms or the Services shall not exceed the amounts paid by you to Truck Flow, LLC for the Services during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.

You agree to indemnify, defend, and hold harmless Truck Flow, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be brought exclusively in the state or federal courts located in Lake County, Illinois, and you consent to the personal jurisdiction of such courts.

12. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Truck Flow, LLC regarding your use of the Services and supersede any prior agreements on the same subject matter. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
